Legal services in Brazil for foreign clients and Brazilians living abroad

Assistance in Brazil for people who live outside the country but have a property, an inheritance, a family matter, or a contract pending here.

Who this is for

This practice regularly assists two groups: foreigners who have, or want to have, a legal interest in Brazil (usually a property), and Brazilians who moved abroad but still have a legal matter pending in the country — most often a family inheritance.

In both cases, the common challenge is the same: the client is not physically in Brazil for most of the process, and needs a clear explanation of what Brazilian law actually requires.

Matters most commonly handled

  • Buying or selling real estate in Brazil, including contract review and due diligence
  • Inheritance proceedings (inventário) involving heirs who live in Brazil and abroad
  • Family and divorce matters with an international element
  • Review of contracts signed in Brazil
  • Representation in Brazil through a power of attorney, for matters that do not require the client's physical presence

How remote assistance works

Not every step can be done remotely — some procedures legally require a signature in Brazil or before a notary. When that is the case, a power of attorney (procuração), signed abroad and properly legalized, often allows the lawyer to act on the client's behalf for that specific step.

What can be handled remotely, such as document review and case strategy, is handled remotely by default — there is no reason to require travel when it is not legally necessary.

International client or tourist?

An international client has a longer-term legal matter in Brazil — a property, an inheritance, a power of attorney, a divorce or a contract — and is usually assisted remotely. A tourist has a problem that arose during a trip, such as a delayed flight, lost baggage or a vacation rental scam. If your situation is the second one, the relevant pages are those for travellers.

FAQ

I am not a Brazilian citizen. Can I still inherit property in Brazil?

Brazilian law generally allows foreign heirs to inherit assets located in Brazil, subject to the applicable inheritance rules. Each estate should be reviewed individually, since the documents required and the procedure can vary.

Can a power of attorney signed outside Brazil be used here?

Often yes, once it is properly executed and legalized according to the requirements that apply in the country where it was signed (which may include notarization and, depending on the country, an apostille). The specific requirements depend on where the document is signed.

Do you handle matters outside Brazil?

No. The practice is licensed under Brazilian law only (OAB/SC 34.030) and assists exclusively with matters governed by Brazilian law, even when the client lives abroad.
